Welcome to ahsk! These Terms of Service ("Terms") govern your use of ahsk on macOS, Windows, iPhone and iPad, including the iPhone keyboard extension, the ahsk website, and your ahsk account (together, the "Service"). By using ahsk, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ahsk, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

ahsk is a dictation application for macOS, Windows, iPhone and iPad that provides:

•Dictation that types cleaned-up text into whatever application you are using
•Hands-free dictation, and translation while you speak
•AI answers, rewriting, and questions about text you have selected or what is on your screen
•Meeting notes recorded from your microphone and your computer's own audio, on macOS and Windows
•A launcher, snippets, clipboard history and a personal dictionary, on macOS and Windows
•A keyboard extension for iPhone and iPad carrying the same dictation modes and dictionary

3. Account and Registration

3.1 Account Creation

•You must sign in using Google Sign-In or Apple Sign-In to use ahsk
•You must provide accurate and complete information
•You are responsible for maintaining the security of your account
•You must be at least 13 years old to use ahsk (or the age of majority in your jurisdiction)

3.2 Account Termination

•You may delete your account at any time through the app settings
•We reserve the right to suspend or terminate accounts that violate these Terms

4. Free Tier and Subscriptions

4.1 Free Tier

•Every new account includes 10,000 dictated words at no charge, with no card required
•The free tier also includes one-time allowances of 20 translations, 20 web searches, 20 AI answers and 10 video downloads
•Meeting notes are limited to 10 hours per calendar month on every plan, including the free tier
•Free words do not expire and are not replenished monthly
•When your free words are used, a paid plan is required to keep dictating

4.2 Paid Plans

•Pro: unlimited dictation, translation and AI features across macOS, Windows, iPhone and iPad
•Teams: a per-seat plan that adds an administrator view of team usage totals, never the text of what members dictate
•Plans purchased on the website are billed through Stripe. Plans purchased inside the iPhone or iPad app are billed through your Apple ID
•Current prices are shown on the pricing page and inside the app before you pay

4.3 Subscription Terms

•Subscriptions renew automatically for the same period until they are cancelled
•Website subscriptions can be cancelled at any time from your dashboard and remain active until the end of the period already paid for
•App Store subscriptions renew unless auto-renew is switched off at least 24 hours before the end of the current period, and are managed in your App Store account settings
•Refunds for website purchases are handled by us on request at support@ahsk.app. Refunds for App Store purchases follow Apple’s refund policy
•Team seats are billed per member, and seats that are no longer in use are removed before the next renewal

4.4 Price Changes

•We reserve the right to change subscription prices with 30 days' notice
•Price changes will not affect your current subscription period
•Continuing use after price changes constitutes acceptance of new prices

5. Permissions and Keyboard Extension

5.1 Full Access Permission

ahsk keyboard requires "Full Access" permission to:

•Transcribe your voice using secure cloud APIs
•Provide AI-powered web search responses
•Offer instant translation features
•Sync settings between the keyboard and main app

5.2 Desktop Permissions

On macOS and Windows, ahsk asks for the permissions each feature needs:

•Microphone: to record while you dictate. The microphone is opened when you start and closed when you stop
•Accessibility: to insert text at your cursor in other applications and to read the text you select
•Screen and system audio recording: only for meeting notes and for questions about what is on your screen, and only while you use those features

5.3 Data Handling

•Voice recordings are sent to our servers for transcription only
•Voice data is NOT stored permanently on our servers
•Voice data is encrypted during transmission
•We do not access typed text from other apps

5.3 Microphone Access

•ahsk requires microphone access for voice transcription
•Microphone data is only captured when you press the microphone button
•You can revoke microphone access at any time through iOS Settings

6. Acceptable Use Policy

You agree NOT to:

•Use ahsk for any illegal or unauthorized purpose
•Abuse or exploit the Service in ways that harm other users
•Attempt to reverse engineer, decompile, or hack the Service
•Use automated systems or bots to interact with the Service
•Violate any applicable laws or regulations
•Share your account credentials with others
•Use the Service to transmit spam, malware, or harmful content

7. Intellectual Property

7.1 Ownership

•ahsk and its original content, features, and functionality are owned by ahsk and protected by international copyright, trademark, and other intellectual property laws
•Your transcriptions and user-generated content remain your property

7.2 License to Use

•We grant you a limited, non-exclusive, non-transferable license to use ahsk for personal use
•You may not copy, modify, distribute, sell, or lease any part of our Service

8. Third-Party Services

ahsk integrates with third-party services:

•Google Sign-In: Subject to Google's Terms of Service
•Apple Sign-In: Subject to Apple's Terms of Service
•Firebase: For authentication and data storage
•Groq API: For voice transcription and AI features
•DeepL API: For translation services (with Groq fallback)
•Stripe: For payments made on the website. We never see or store your card details
•Vercel: For hosting the website and its API
•Additional AI providers: OpenAI, Cerebras, Sarvam and Tavily may process a request when a feature calls for it
•Spacemail: For account and support email

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

•ahsk is provided "as is" and "as available"
•We do not guarantee uninterrupted, timely, secure, or error-free service
•We may modify, suspend, or discontinue features at any time
•Transcription accuracy is not guaranteed and depends on audio quality, accent, and language

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

•We are not liable for any indirect, incidental, special, consequential, or punitive damages
•We are not liable for any loss of profits, revenue, data, or goodwill
•Our total liability shall not exceed the amount you paid in the 12 months prior to the claim

9.3 No Warranty

•We make no warranties about accuracy, reliability, or availability
•We do not warrant that the Service will meet your requirements
•We are not responsible for loss of data or content

10. Indemnification

You agree to indemnify and hold harmless ahsk, its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

•Your use of the Service
•Your violation of these Terms
•Your violation of any rights of another person or entity

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Changes to Terms

•We may update these Terms at any time
•We will notify you of material changes via the app or email
•Your continued use after changes constitutes acceptance
•If you do not agree to changes, you must stop using the Service

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.2 Dispute Resolution

•You agree to first contact us to resolve any disputes informally
•If informal resolution fails, disputes will be resolved through binding arbitration
•You waive the right to participate in class-action lawsuits

13.3 Jurisdiction

You agree to the exclusive jurisdiction of courts in the United States for any disputes.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ahsk regarding the Service.

17. App Store Terms

17.1 Apple App Store

By downloading ahsk from the Apple App Store, you agree to:

•Apple's Terms of Service
•Apple's Licensed Application End User License Agreement (EULA)
•Apple's handling of subscriptions and payments

17.2 Subscriptions via Apple

•All subscription purchases are handled by Apple
•Refunds are subject to Apple's refund policy
•Subscription management is done through your Apple ID account settings
